CM/ECF v4.x Release Notes

All items in the release notes below will be active and functional in v4.2 except for the following: Password Security, Filing Agents, Filing Fee Lockout, RSS feeds, Email related case option, CM/ECF E-Orders processing, Full text search, and ACH (bank routing number) transactions.

Due to the Judicial Conference Privacy Policy, CM/ECF v4.2 restricts PACER access to electronically filed documents on closed cases filed before December 1, 2003.


List of known issues with CM/ECF v4.x recently discovered

1. ECF 4.x is incompatible with certain case filing software (EZ Filing). We are checking to make sure that the Court has enabled case upload as a work around for affected users.

2. Issue with running a claims register with more than 1000 claims. Not SDSD Verified.

3. Internet version of cases report and docket activity (United States Trustee) may limit users to 31 days of activity


New CM/ECF Docket Events for December 1 Rule 3002.1 Requirements

New docket events have been created for the December 1 Rule 3002.1 requirements. To ensure proper docketing of matters relevant to Rule 3002.1, please utilize the following events located in CM/ECF.

Bankruptcy - Claim Related Matters -

Notice of Mortgage Payment Change - New Form B 10 (Supplement 1) - Used by mortgage holder to provide notice of payment adjustments;

Notice of Postpetition Mortgage Fees, Expenses and Charges - New Form B 10 (Supplement 2) -- Used by mortgage holder to provide itemization of postpetition expenses and date additional charges were incurred;

Response to Notice of Final Cure Payment (no official form) - Filed as supplement to the claim and in response to Notice of Final Cure Payment filed by trustee or debtor. Please note that to obtain a hearing to determine the final cure payment, a Motion to Determine Final Cure and Mortgage Payment must be filed within 21 days of the Response.

Bankruptcy - Motions / Applications / Objections -

Motion to Determine Final Cure and Mortgage Payment (no official form) - Filed by debtor or trustee within 21 days after Response to Notice of Final Cure Payment in order to obtain a hearing as to whether debtor has cured default and paid all required postpetition amounts.

Motion to Determine Mortgage Fees and Expenses (no official form) - Filed by debtor or trustee within one year of Notice of Postpetition Mortgage Fees, Expenses and Charges (Supplement 2) to determine whether payment is required by underlying agreement to cure default or maintain payments;

Bankruptcy - Trustee/US Trustee -
